The personal injury trial in Judge Barry Lawrence’s court of Smith v. Volkswagen will finish early next week. (See my blog for June 7 and June 8) Plaintiff’s case rested yesterday (Friday), then the defense called its fire expert, neuroradiologist, and chemical engineer- all essentially questioning the causation of Ms. Smith’s alleged brain injuries.
This brain injury case will go to the jury on Tuesday or Wednesday, according to plaintiff’s counsel. The sense of courtroom observers is that the jury’s focus will be on whether the leaking fuel line caused CO emission and poisoning.
