Yesterday the defense filed its Reply Memorandum on the motion for new medical malpractice brain injury trial in Scott v. University Hospital. (See my post for April 21.) This lengthy memorandum is of interest for its discussion of “Reptile” trial tactics, and more generally on appropriate jury argument, especially “conscience of the community” pleas.
